House rules for social media
Thank you for joining Motorserve Pty Ltd (“we”, “us” or “Motorserve”) on social media. We can provide information about our products and services.
IS THE CONTENT YOUR OWN?
If the content is not your own, you'll need permission from the owner before posting it. We ask that you do your part and comply with these rules for posts, communications and general behaviour on our pages.
WHEN WILL WE DELETE POSTS?
While we appreciate all types of feedback, we reserve the right to delete posts that we decide are off-topic, otherwise inappropriate, or don’t comply with these rules. However, we have no obligation to remove any content. We also reserve the right to remove or block users at our discretion if a user fails to comply with these rules.
This includes posts that contain:
- Defamatory, obscene, offensive or violent language and / or images
- Trolling, spamming, fraudulent or deliberately misleading posts
- Repetitive or continuous posts, including complaints that have already been responded to by us
- Attacks on specific groups or any comments meant to harass, threaten or abuse an individual
- Hateful or discriminatory comments regarding race, ethnicity, religion, gender, disability, sexual orientation or political beliefs
- Links or comments containing sexually explicit content material
- Websites or files containing viruses that could damage the operation of other people’s computers or mobile devices
- Commercial solicitations
- Unreasonable or inappropriate disclosure of someone else's personal information
- An infringement of another party’s intellectual property rights.

When a response is needed to any posts on our social media pages, we'll aim to respond to your comments within 24 hours, Monday to Friday. During public holidays, response times may vary.
DON'T SHARE YOUR PERSONAL INFORMATION.
Your privacy is important to us. Remember that posting on public pages means anyone can see your information, so you should only share information you are happy for the general public to see. Please don't share personal information on this page such as your phone number email address, or otherwise share information such as vehicle registration details. You are also bound by the privacy policies of that site.
If we believe that your enquiry requires us to identify you (for example, as our customer), we cannot answer you in the public section of the channel. Instead, we will let you know and your enquiry can progress by private or direct messages. Sometimes, we may ask you to contact our customer service teams directly.

YOUR RIGHTS
In addition to the rights you grant to the relevant social media platform, you also grant Motorserve and its related bodies corporate the right to use and/or distribute any content posted by you in any manner on its social media platforms or for internal purposes (this includes reposting or resharing your content) without any legal or monetary obligation to you. Where Motorserve intends to use your content for other marketing or promotional purposes other than those specified above, Motorserve will endeavor to seek your consent prior to such use.
The content posted by users does not necessarily reflect the views or opinions of Motorserve and/or Insurance Australia Group Limited (IAG), and Motorserve and/or IAG do not confirm the accuracy of such content. Motorserve and its related bodies corporate do not endorse, and are not accountable for, any views expressed by third parties using that site.
COMPETITIONS/GAMES OF SKILL RULES
We (Insurance Australia Limited t/as Motorserve ABN 41 121 715 393) may from time to time run games or competitions ("Competitions") through an unpublished Facebook/Instagram post or through a timeline post on our Facebook/Instagram page at facebook.com.au/motorserve and instagram.com.au/Motorserve which incorporate these Rules. These Rules limit Motorserve’s liability for certain types of loss or damage, and permit Motorserve to disclose your information to third parties (in accordance with the Motorserve Privacy Policy). If we run a Competition that directs you to these Rules as the rules of participation:
1. Our post will set out the relevant Competition details, such as when the Competition commences and ends, how to enter, who is allowed to enter, how winners will be selected, contacted and announced and what the prizes are.
2. Entrants must be aged 13 years and over.
3. Any Competition which directs you to these House of Rules as the rules of participation are games of skill, not games of chance, as no element of chance is involved.
4. All prize values are in Australian dollars. Each prize must be taken as stated and no compensation will be payable if a Winner is unable to use the Prize as stated. Prizes will only be distributed in Australia and all components of the prizes are not transferable and not redeemable for cash or other goods or services.
5. Entries that do not fully comply with these Rules, including those that are incomplete, indecipherable or illegible, will be deemed invalid.
6. Entrants warrant that they own the intellectual property rights in relation to their entry and that their entry is their own original creative work and does not infringe the rights of any third party
7. Entries are deemed to be received at the time of receipt by us. Motorserve has no control over telecommunications networks and accepts no responsibility for problems associated with them. We are not responsible for any delay in, or failure of, transmission in circumstances beyond Motorserve’s reasonable control which causes an entry not to be received between the commencement and end of the Competition. Entries submitted using any form of automated entry device or software are ineligible.
8. We reserve the right to review all comments and if we deem any to be obscene, offensive, defamatory, inappropriate, unsuitable or infringing (or including any such content), we may invalidate the entries with which the comments were submitted.
9. We reserve the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who:
a) does not act, or submits an entry that is not, in accordance with these Rules;
b) tampers (or benefits from the tampering) with the entry process or the conduct of the Competition; or
c) has, in our reasonable opinion, engaged in conduct which is fraudulent, misleading or generally damaging to our reputation
10. Entries will be judged by us. Our decision in relation to any Competition is final and binding.
11. If you are a winner of a Competition, you must send us a private message with your contact details in order for us to arrange fulfilment of your prize.
12. Subject to State and Territory legislation and any directions from a regulatory authority, we reserve the right to amend, extend, cancel or suspend a Competition in circumstances where an event beyond our reasonable control corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition.
13. Entry and continued participation in a Competition is dependent on you following and acting in accordance with Facebook Statement of Rights and Responsibilities (http://www.facebook.com/terms.php). Our Competitions adhere to the terms and conditions set out in the Facebook promotion guidelines which can be found at: http://www.facebook.com/promotions_guidelines.php. Any questions or comments regarding the Competition must be directed to us, not to Meta. Any Competition we post is not sponsored, endorsed, administered by or associated with, Meta. You release Meta and its associated companies from all liabilities arising in respect of a Competition.
14 . EXCEPT FOR ANY LIABILITY THAT CANNOT BE EXCLUDED BY LAW (IN WHICH CASE THAT LIABILITY IS LIMITED TO THE MINIMUM ALLOWABLE BY LAW), AND SUBJECT TO PARAGRAPHS 15 AND 16, NRMA INSURANCE’S LIABILITY IS LIMITED TO THE VALUE OF THE PRIZE POOL FOR THE COMPETITION.
15.TO THE EXTENT PERMITTED BY LAW, NRMA INSURANCE (INCLUDING ITS OFFICERS, EMPLOYEES AND AGENTS) EXCLUDES ALL LIABILITY (INCLUDING NEGLIGENCE) FOR ANY INDIRECT OR CONSEQUENTIAL LOSSOR DAMAGE
16. Nothing in these Rules restricts, excludes, modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law, including the Competition and Consumer Act 2010 (Cth).
17. We will collect, use and disclose personal information you provide in accordance with our Privacy Policy available at motorserve.com.au/privacy-policy
18. You or your parent/guardian (if applicable) agree and consent to us:
a. Using and disclosing your personal information for the purposes of conducting the Competition, redeeming a prize and any other matter connected to or incidental to the Competition (including to third parties and any applicable statutory authorities); and,
b. Using the content of your entry in connection with the Competition in any media for an unlimited period without remuneration.
